TERMS OF CARRIAGE


It is hereby declared and agreed between the passenger and French Island Ferry Service Pty. Ltd (ACN 19063401721) ("the Company") that all tickets are issued upon the express condition that it will not assume responsibility at law or in equity for any illness or injury to or the death of the passenger or any damage or loss to any property of the passenger howsoever caused and whether attributable to in any way some negligent act or omission of the Company its servants, subcontractors, contractors or agents.

The Company expressly reserves the right to cancel or vary without notice the service for which this ticket ("the Ticket") was issued to the passenger.

The passenger must comply with the instructions of the ships master and the Company concerning all matters connected with or consequential to the service provided by the Company and must comply with all conditions of this ticket and the terms of any notice exhibited on or near the vessel relating to the terms on which the passenger shall be carried on the vessel.

The Company is not a common carrier and reserves the right to refuse to carry any passenger, luggage or goods without assigning any reason thereto. The Company and/or its employees shall advise the passenger prior to boarding if the amount of luggage and/or weight of the luggage can be accomodated due to restricted deck space, this includes bycycles. The company is under no obligation to carry the passengers luggage if it exceeds a total weigh allowance of 7KG and/or is greater than 115cm in total dimensions. (Total dimensions are measured by adding together the length, height and depth of the bag.) In addition to your carry-on baggage allowance, you may also carry on board one small personal item such as a handbag, laptop computer, overcoat or small camera. All carry on hand luggage/bags must remain with the passenger in the main cabin at all times and shall not to be left unattended at any time.

The Ticket is not transferable to any other person and remains the property at all times of the Company and must be tendered and given up when required by the Company, its employees or its representatives.

The passenger must not, whilst aboard the vessel, consume any intoxicating beverage and/or smoke at any time.

The Company reserves the right to contract with any person or corporation to provide the service for which the Ticket is issued and the Terms and Conditions of Carriage herein ensure for the benefit of such person or corporation to the same extent as they apply to the Company.

The ticket is valid only for the service endorsed on the day of the ticket.

The Company reserves the right to decide the suitability or otherwise of meteorological and other conditions for the service and to modify the time and place of embarkation or disembarkation and the routine.

No liability shall attach to the Company for any loss or damage which may arise or be alleged to arise in the event of the cancellation of this service or any deviation or delay in this service or the abandonment of this service during the course thereof arising from any cause whatsoever including without limitation strikes, industrial disputes, mechanical breakdowns or inclement weather.

In these conditions the expression, "the Company" includes its servants, contractors, subcontractors and agents and any reference to "the passenger" means the passenger to whom the Ticket is issued or who is carried by virtue of the issue thereof. Words importing the singular or plural number of the masculine or feminine gender shall, where context permits, include the plural or singular number of the feminine or masculine gender as the case may permit.
